Terms of Usage
 

Please remember that as a full-time artist, my art is my life. My only source of income is from the paintings, prints and merchandise I sell. Because of this, I must crack down on the use of my art without the guidelines being followed.

Restrictions
 
You may use my art as decoration for your blog, myspace or website, as long as you follow these rules.
 
1. IMAGES MUST REMAIN UNALTERED
 
You may not crop, add details or remove the website stamp on the artwork. You may resize as necessary, as long as it is within constrained proportions. Also, please limit yourself to five of my paintings at any one time.
 
2. ONLY USE THE STAMPED IMAGES FROM THIS SITE
 
You MUST only use paintings as they appear on this site. You may not buy a print, scan it and use that for your site. All images MUST contain the vyktoriah.com stamp.
 
3. CREDIT ME
 
You will need to credit the following: © Vyktoriah Williams and vyktoriah.com
 
4.  NON-COMMERCIAL USE ONLY!
 
If you are selling something on your website, no matter how small, I do not allow free display of my artwork.  If you are interested in licensing my artwork for business use, contact me at vyktoriah@vyktoriah.com.

5.  TATTOOS ARE ALLOWED

However, if you get a tattoo of my work, please remind your tattoo artist that he/she is NOT allowed to offer the same tattoo to other patrons unless they specifically ask and bring their own copy of the work. And by all means, send me a picture of your tattoo once you get it! I will be adding a page soon for all those who do!

Copyright

Despite what some of you seem to think, Copyright does NOT mean "A right to copy."

Copyright applies to Art

Copyright applies to original artistic works such as paintings, drawings, engravings, sculptures, photographs, diagrams, maps, works of architecture and works of artistic craftsmanship.

So, for example, cartoon characters may have copyright protection and if you wish to copy the characters onto cakes, wallpaper and so on, you will almost certainly need a licence to do this to avoid infringing copyright.

If you wish to use or copy copyright protected artistic works you may need the permission for the rights holder, unless copyright exceptions apply.

As for drawing of articles to be mass-produced, there will only be copyright in the article made to the design in the drawing if the article itself is an artistic work, including something that could be called a work of artistic craftsmanship.

However, design right protection might exist for such an industrially produced item even if there is no copyright and applying for a registered design is another possibility.


Duration and ownership

The creator of the work will be the author and first owner and copyright will last for life of the author plus 70 years.

Copyright is, however, a form of intellectual property which, like physical property, can be bought or sold, inherited or otherwise transferred, wholly or in part. So, some or all of the economic rights may subsequently belong to someone other than the first owner.


In other words, everything you see on this website, from each and every piece of art, to every word written (unless otherwise stated) to the site design and graphics belong to ME. You did not create ANY of it, and you do not have ANY right to use it without permission. There is no "get out of jail free" card to play when it comes to using other people's art.

If you want to create tubes, signatures, collages, etc using art, ask yourself the following questions:

1. Did I draw it?
2. Did I buy the copyright to this picture?
3. Do I have the permission of the artist to use this art in the way I'm intending?

If you can answer yes to any of these questions, then by all means use it. But if the answers all point to "no," then do yourself and the artists a favour, and move on. Don't make me track you down and get all legal. I want to make art that people enjoy. Not that they steal and make me battle for.
